In a precedent-setting Americans with Disability case for a blind law student, a federal judge ruled on April 4th, 2025, that David Nacht’s client could go to trial against Wayne State University for failing to provide her with the opportunity to attend school remotely. The case is important for employment law as well as education law. The court accepted Nacht’s argument that post-Covid, allowing a student to attend remotely must be available as a reasonable accommodation.
David Nacht states:
“We can expect that this case will alter practices of colleges and universities to provide remote access to students with disabilities. Covid changed what is normal. Tens of millions of Americans went to school or worked remotely. Even if remote access is no longer the norm, employers and colleges should provide that opportunity for disabled people to participate fully in American life.”
