David Nacht prevailed against the University of Michigan in the Michigan Court of Appeals in a battle over the statute of limitations that applies in lawsuits against the State of Michigan and state universities in civil rights claims.
Nacht argued that the one-year statute of limitations governs; and the university had appealed from Nacht’s victory on that point in the Court of Claims.
The University claimed that suits under the Elliott Larsen Civil Rights Act were “personal injury claims” and the time-period that governs is six months.
This was the first court of appeals decision to decide the issue – a hotly contested legal point for state and university employees in the last few years.
