Disability Discrimination Claim Victory

Nacht Law filed a disability discrimination claim in Oakland County Circuit alleging disability discrimination committed by a private religious high school (Notre Dame Prep) for refusing to admit a learning disabled student. The school responded by filing a motion to dismiss, on two grounds: (1) claiming that they were exempt from the Persons With Disabilities Civil Rights Act on the basis of “ecclesiastical privilege,” as well as (2) arguing that we could not show sufficient facts to support our claim. Judge Rudy Nichols issued a written opinion denying their motion on both grounds. The case will proceed to trial. The case is Winkler v. Marist Fathers of Detroit et al.
