The U.S. Department of Education has issued a final rule removing its 2024 Title IX regulations from the Code of Federal Regulations and restoring the regulations that applied before that rule. The Department says the change updates the published regulations to reflect court decisions that vacated the 2024 rule. The final rule is scheduled to take effect upon publication in the Federal Register. Read the final rule.
Title IX prohibits sex discrimination in education programs and activities that receive federal financial assistance. The restored regulations include the 2020 rule’s requirements for how schools handle complaints of sex discrimination, including procedures for investigating and resolving sexual harassment complaints. The Department says it has been enforcing the pre-2024 regulations since early 2025.
Schools and colleges should review the regulations and applicable court decisions when assessing their policies and procedures. The final rule restores the earlier regulatory text, with several limited exceptions described by the Department. Read the Department’s announcement.
