Helping Teachers Protect Their Rights And Careers Throughout The Criminal Process
As a teacher, you know that you are held to high legal and professional standards in and out of the classroom. You may recognize the risks that a criminal conviction can have on your livelihood. However, did you know that Michigan’s School Safety Act requires that teachers self-report criminal matters that don’t result in a conviction?
Although this legislation was passed in 2005, few criminal defense attorneys are intimately familiar with its requirements, which can have devastating effects on their clients. At NachtLaw, P.C., our team has a deep understanding of the School Safety Act. Whether you have been charged with a misdemeanor or felony offense, our criminal defense, employment law and education law attorneys will work in tandem to help you resolve this matter as expeditiously as possible.
What You Need To Know About The School Safety Act
Teachers need to submit disclosure forms to the Michigan Department of Education (MDE) and the teacher’s school district within three business days of an arraignment or conviction. Because prosecutors are obligated to report convictions to schools, this report is often filed on time. Prosecutors do not have this obligation during an arraignment, creating problems for defendants.
Failing to submit the necessary forms to the required parties in the mandated time period can result in job termination and additional charges. It does not matter if you are unaware of your obligations to report an arraignment or conviction. You can still be punished.
